MJW Electrical Projects - Terms and Conditions of Quotation and Supply of Electrical Services
1. Definitions
Business means MJW Electrical Projects.
Customer means the person, company or entity requesting or accepting the quotation.
Works means all electrical services, labour, materials, equipment, testing, inspections and installations supplied by MJW Electrical Projects.
Variation means any additional work outside the original quotation.
2. Acceptance
These Terms apply to all quotations, invoices and works carried out by MJW Electrical Projects.
The Customer accepts these Terms by:
accepting a quotation;
paying a deposit;
requesting work to commence;
allowing work to commence; or
accepting completion of the works.
3. Quotations
All quotations are valid for 30 days unless otherwise stated.
Quotations are based upon information available at the time of inspection.
Should site conditions differ from those originally inspected, MJW Electrical Projects reserves the right to revise the quotation.
Unless specifically stated, quotations exclude:
plastering
painting
tiling
excavation
civil works
asbestos removal
builder's works
network authority charges
supply authority upgrades
permits unless stated.
4. Variations
Any work outside the original quotation will be treated as a Variation.
Variations may result from:
customer requests
concealed wiring
damaged cables
deteriorated switchboards
non-compliant installations
asbestos
inaccessible wiring
supply authority requirements
additional testing.
Variation work will be quoted where practical before commencement.
Where immediate work is required to make an installation safe, the Customer authorises MJW Electrical Projects to carry out the necessary work and invoice accordingly.
5. Switchboard Upgrades
The Customer acknowledges that switchboard upgrades frequently expose pre-existing defects that cannot
reasonably be identified before work commences.
These may include:
deteriorated wiring
undersized mains
damaged insulation
non-compliant earthing
missing MEN connections
damaged meter panels
asbestos backing boards
overloaded circuits
defective safety switches
incorrect circuit identification.
Any work required to rectify these issues is not included unless specifically stated within the quotation.
6. Existing Installations
MJW Electrical Projects accepts no responsibility for faults existing before work commenced.
The Customer understands that:
electrical faults may only become apparent after testing;
replacement of one component may expose faults elsewhere;
older wiring systems may not comply with current Australian Standards.
Where unsafe conditions are identified, MJW Electrical Projects may refuse to reconnect the installation until it is made safe.
7. Customer Supplied Equipment
MJW Electrical Projects accepts no responsibility for:
customer supplied fittings
online purchases
second-hand equipment
compatibility issues
warranty claims.
Labour to install customer supplied equipment remains chargeable.
8. Access
The Customer shall provide unrestricted access to the work area.
Additional charges may apply where delays result from:
locked premises
furniture
stored materials
other trades
pets
unsafe conditions
restricted access
9. Underground Services
Unless specifically quoted, MJW Electrical Projects is not responsible for locating underground services.
The Customer warrants that all underground services have been identified before excavation.
10. Asbestos
If asbestos or suspected asbestos is identified, work will cease immediately.
Removal must be undertaken by a licensed asbestos contractor at the Customer's expense.
11. Delays
Completion dates are estimates only.
MJW Electrical Projects shall not be liable for delays caused by:
weather
supplier shortages
network authority delays
inspection delays
customer changes
industrial action
power outages
events beyond reasonable control
12. Payment
Unless otherwise agreed:
deposits are payable before commencement;
progress claims may be issued;
final payment is due on completion
Ownership of supplied materials remains with MJW Electrical Projects until payment is received in full.
13. Late Payment
Overdue invoices may incur interest and reasonable debt recovery costs permitted by law.
MJW Electrical Projects reserves the right to suspend further work until overdue accounts are paid.
14. Electrical Compliance
All work will be carried out in accordance with:
AS/NZS 3000 (Wiring Rules)
applicable Australian Standards
local electricity distributor requirements
State electrical legislation
Where existing installations fail to comply with current safety requirements, additional work may be necessary.
15. Testing
Testing forms part of every installation.
Testing may require temporary interruption of power.
MJW Electrical Projects is not liable for loss arising from temporary power outages required to safely complete testing.
16. Warranty
MJW Electrical Projects warrants its workmanship for 12 months.
Manufacturer warranties apply separately.
Warranty excludes:
misuse
accidental damage
vermin
water ingress
storms
lightning
customer modifications
work by third parties
fair wear and tear.
17. Limitation of Liability
To the maximum extent permitted by law, MJW Electrical Projects shall not be liable for indirect or
consequential loss including:
business interruption
loss of profits
data loss
inconvenience
accommodation costs.
Nothing excludes rights under Australian Consumer Law.
18. Photographs
MJW Electrical Projects may take photographs of works before, during and after completion for:
record keeping
warranty purposes
training
insurance
marketing
Customer addresses and identifying information will not be published without consent.
19. Defects
The Customer must notify MJW Electrical Projects of any alleged defect within a reasonable time.
The Business must be given reasonable opportunity to inspect before another contractor performs repairs.
Failure to do so may void any workmanship warranty.
20. Cancellation
If the Customer cancels after materials have been ordered or work has commenced, the Customer agrees to pay for:
labour completed
materials purchased
restocking fees
hired equipment
administration costs
21. Force Majeure
MJW Electrical Projects shall not be liable for failure to perform obligations where prevented by circumstances beyond reasonable control.
22. Governing Law
These Terms are governed by the laws of the Australian State or Territory where the works are undertaken.
23. Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any consumer guarantee or right under the Competition and Consumer Act 2010 (Cth) or Australian Consumer Law.
24. Acceptance
Acceptance of a quotation, payment of a deposit, issue of a purchase order or allowing work to commence constitutes acceptance of these Terms and Conditions.
